Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Community Portal websites and services at communityportal.co and app.communityportal.co (the "Service"), operated by Boffo Digital, LLC ("Community Portal," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an association or organization, you represent that you are authorized to bind it to these Terms.
The Service
Community Portal provides software for community associations to store official records, track statutory compliance tasks and deadlines, generate compliance artifacts, and publish a public website. The Service is a record-keeping and workflow tool.
Not legal advice
Community Portal is not a law firm, and using the Service does not create an attorney-client relationship. Statutory references, checklists, scores, and generated documents are provided for general informational and operational purposes and may not reflect the most current law or your association's specific circumstances. You are responsible for your association's compliance, and you should consult a licensed attorney for legal advice.
Accounts and eligibility
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account and for your authorized users. Notify us promptly of any unauthorized use. You must be at least 18 years old to use the Service.
Subscriptions, fees, and trials
- Paid plans are billed in advance on a recurring basis through our payment processor (Stripe) until cancelled. Fees and plan features are described at the time of purchase.
- Free trials, where offered, convert to a paid plan unless cancelled before the trial ends.
- Except where required by law, fees are non-refundable. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- We may change pricing on prospective notice; changes do not affect the period you've paid for.
Your content
You retain all rights to the documents, records, and other content you submit ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely to provide the Service to you. You are responsible for having the rights to your content and for its accuracy, and for complying with applicable law (including handling of personal information in your records). Our handling of personal information is described in our Privacy Policy.
Acceptable use
You agree not to:
- use the Service unlawfully or to infringe others' rights;
- upload malicious code or attempt to disrupt, probe, or gain unauthorized access to the Service;
- reverse engineer or resell the Service except as permitted by law or your plan;
- use the Service to store content you are not authorized to share with your association's users.
Third-party services
The Service integrates with third-party services you choose to connect, such as Google Calendar. Your use of those services is governed by their own terms and privacy policies, and your use of the Google Calendar integration is also subject to our Privacy Policy. We are not responsible for third-party services.
Intellectual property
The Service, including its software, design, and content (excluding Customer Content), is owned by Community Portal and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will ensure compliance with any statute or regulation.
Limitation of liability
To the maximum extent permitted by law, Community Portal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless Community Portal from claims arising out of your Customer Content, your use of the Service, or your violation of these Terms or applicable law.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. On termination, your right to use the Service ends; we will make Customer Content available for export for a limited period as described in our Privacy Policy, after which it may be deleted.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. The exclusive venue for disputes is the state and federal courts located in Travis County, Texas, unless otherwise required by law.
Changes to these Terms
We may update these Terms as the Service evolves or as the law requires. For material changes we'll provide notice, and your continued use after changes take effect constitutes acceptance.
